MarAmi Vineyards (“MarAmi,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect when you visit maramivineyards.com (the “Site”), purchase wine, join our wine club, or otherwise interact with us, how we use that information, and the rights you have over it. This policy applies to U.S. residents, including residents of California.

By using our Site or providing your information to us, you agree to the practices described in this Privacy Policy.

1. Who We Are

MarAmi Vineyards is a direct-to-consumer winery based in California. We sell wine and offer a wine club to consumers of legal drinking age in jurisdictions where we are permitted to ship.

2. Information We Collect

We only collect information that you provide to us directly, or that is collected automatically through standard website analytics tools when you visit the Site.

Information You Provide to Us

  • Customers and Wine Club Members: When you purchase wine or join our wine club, we collect your name, shipping and billing addresses, phone number, email address, date of birth (for age verification, as required by law for the sale and shipment of alcohol), and a tokenized payment authentication. We do not store your full credit card number; payment information is handled by our payment processor (see Section 4).
  • Mailing List Subscribers: If you sign up for our mailing list, we collect your name and email address. By signing up, you opt in to receive marketing communications from us.
  • Contact Form Submissions: When you use the contact form on our Site, we collect the information you choose to provide (typically name, email, and your message). The contact form includes an optional checkbox to opt in to receive marketing communications. If you do not check this box, we will only use your information to respond to your inquiry.

Information Collected Automatically

Our Site uses Google Analytics and the Meta (Facebook) Pixel. These tools may automatically collect standard analytics data including:

  • IP address (typically truncated or anonymized)
  • Browser type and version
  • Device type and operating system
  • Referring website
  • Pages visited on our Site and time spent on each
  • Approximate geographic location (derived from IP address)
  • Interactions with our Site, such as clicks and scrolls

These tools also use cookies and similar technologies to recognize returning visitors and measure advertising performance. Information collected by Google Analytics and the Meta Pixel may be combined with information those companies have collected from other sources, in accordance with their respective privacy policies.

Our content management system also sets a single anonymous cookie used for basic site functionality. This cookie does not contain any personal information or identifiers.

Information We Do Not Collect

We do not knowingly collect personal information from anyone under the age of 16. We do not sell wine to, and do not knowingly collect information from, anyone under the legal drinking age. If you believe we have inadvertently collected information from a minor, please contact us at contact@maramivineyards.com and we will delete it.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To process and fulfill your wine orders, including age verification, shipping, and payment processing
  • To administer your wine club membership and process recurring club shipments
  • To communicate with you about your orders, account, or inquiries
  • To send marketing emails to customers, club members, mailing list subscribers, and contact-form opt-ins, in accordance with the CAN-SPAM Act
  • To improve our Site, products, and customer experience through analytics
  • To measure the effectiveness of our advertising
  • To comply with legal obligations, including alcohol shipping laws, tax laws, and recordkeeping requirements
  • To prevent fraud and protect the security of our Site and customers

You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing message we send, or by contacting us directly. We will continue to send transactional messages (such as order confirmations and shipping notifications) as necessary to fulfill your purchases.

4. How We Share Your Information

We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.

We share information only with service providers that help us operate our business, and only to the extent necessary for them to perform their services. These service providers are contractually required to protect your information and use it only for the purposes we specify. They include:

  • Commerce7: our e-commerce platform, which manages customer accounts, orders, wine club memberships, and currently handles transactional and marketing emails.
  • Fullsteam (via Commerce7): our payment processor, which handles tokenized payment authentication and processes credit and debit card transactions.
  • Shipping carriers: to deliver wine to you, we provide your name, address, phone number, and date of birth (as required by law) to licensed common carriers.
  • Google Analytics: for website analytics, as described in Section 2.
  • Meta (Facebook): for advertising measurement and audience analytics through the Meta Pixel, as described in Section 2.
  • Klaviyo (planned): we anticipate transitioning our email marketing to Klaviyo in the future. When we do, this policy will be updated to reflect that change.

We may also disclose your information when required by law, such as in response to a subpoena, court order, or other legal process; to enforce our terms; to protect our rights, property, or safety, or that of our customers or others; or in connection with a business transfer, such as a merger or sale of assets, in which case we will notify you and any successor will be required to honor this Privacy Policy.

5. Cookies and Tracking Technologies

Our Site uses cookies and similar tracking technologies. The categories of cookies used on our Site are:

  • Strictly necessary cookies: set by our content management system to enable basic Site functionality. These do not contain personal information.
  • Analytics cookies: set by Google Analytics to help us understand how visitors use the Site.
  • Advertising cookies: set by the Meta Pixel to measure the performance of our advertising and reach relevant audiences.

Most web browsers allow you to control cookies through your browser settings. You can also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout, and you can adjust your Meta ad preferences in your Facebook or Instagram account settings.

We do not currently respond to “Do Not Track” browser signals, as no consistent industry standard has been established. We do honor recognized opt-out preference signals (such as the Global Privacy Control, or GPC) from California residents as a request to opt out of the sharing of personal information for cross-context behavioral advertising, as described in Section 7.

6. How Long We Keep Your Information

We retain your personal information for as long as your account or wine club membership is active, or as long as needed to provide you with our products and services. Order history and customer records are retained indefinitely, unless you request deletion.

We may retain certain information for longer if required by law, such as for tax, accounting, or alcohol-shipping recordkeeping purposes, or as needed to resolve disputes, prevent fraud, or enforce our agreements. When we no longer have a legitimate business or legal reason to retain your information, we will delete or anonymize it.

7. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), gives you certain rights regarding your personal information. This section describes those rights and how to exercise them.

Categories of Personal Information We Collect

In the past 12 months, we have collected the following categories of personal information, as defined by the CCPA:

  • Identifiers: name, email address, postal address, phone number, IP address, and online identifiers.
  • Customer records: billing and shipping information, order history, wine club membership details.
  • Commercial information: products purchased, considered, or returned, and purchase history.
  • Internet or other electronic network activity: browsing and interaction data collected through Google Analytics and the Meta Pixel.
  • Geolocation data: approximate location derived from IP address.
  • Inferences: inferences drawn from the above to create a profile reflecting preferences and characteristics, primarily for product recommendations and marketing.
  • Sensitive personal information: we collect date of birth solely for the purpose of age verification required by alcohol-shipping laws. We do not use or disclose this information for any purpose other than as permitted by California Civil Code section 1798.121.

We collect this information from the sources, and use it for the purposes, described in Sections 2 and 3. We disclose this information to the categories of service providers described in Section 4.

Sale and Sharing of Personal Information

We do not sell personal information for monetary consideration.

However, our use of the Meta Pixel and Google Analytics for advertising purposes may be considered “sharing” of personal information for cross-context behavioral advertising under the CCPA. You have the right to opt out of this sharing.

To opt out of sharing for cross-context behavioral advertising, you can:

  • Email us at contact@maramivineyards.com with the subject line “Do Not Share My Personal Information,” or
  • Enable the Global Privacy Control (GPC) in a supported browser. We will treat a recognized GPC signal as a valid opt-out request for the browser and device from which it is sent.

We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your Rights

Subject to certain exceptions, California residents have the right to:

  • Right to know: request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we share it.
  • Right to delete: request that we delete personal information we have collected from you.
  • Right to correct: request that we correct inaccurate personal information we maintain about you.
  • Right to opt out of sale or sharing: as described above.
  • Right to limit use of sensitive personal information: request that we limit the use of your sensitive personal information to purposes specified by the CCPA. As noted above, we already use date of birth only for age verification, which is a permitted purpose.
  • Right to non-discrimination: we will not discriminate against you for exercising any of these rights.

How to Exercise Your Rights

To exercise any of these rights, please email us at contact@maramivineyards.com with a description of your request. We will need to verify your identity before responding, which typically means matching information you provide in your request with information we already have on file (such as your name, email address, or recent order details). We will not ask you for more information than is reasonably necessary to verify your identity.

You may also designate an authorized agent to make a request on your behalf. We will require written proof of the agent’s authorization and may require you to verify your own identity directly with us.

We will respond to verifiable requests within 45 days. If we need more time, we will let you know and explain why. There is no fee to make a request unless it is excessive, repetitive, or manifestly unfounded.

Shine the Light

California Civil Code section 1798.83 (the “Shine the Light” law) permits California residents to request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes. As stated above, we do not share personal information with third parties for their own direct marketing purposes.

8. Other U.S. Residents

Residents of other U.S. states may have similar rights to access, delete, or correct their personal information under applicable state privacy laws. To make a request, please email us at contact@maramivineyards.com. We will respond to verifiable requests in accordance with applicable law.

9. Requesting Removal of Your Information

Regardless of where you live, you may request that we remove your information from our records at any time. To do so, email us at contact@maramivineyards.com. We will promptly remove your information, except where we are required to retain it by law (for example, alcohol-shipping or tax records) or where retention is necessary to complete a transaction you have initiated.

10. How We Protect Your Information

We use commercially reasonable technical, administrative, and physical safeguards to protect your personal information. Payment card information is tokenized and processed by our payment processor; we do not store full payment card numbers on our systems. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

11. Email Marketing and the CAN-SPAM Act

We send marketing emails to customers, wine club members, mailing list subscribers, and contact-form opt-ins in compliance with the federal CAN-SPAM Act. Every marketing email we send includes a clear way to unsubscribe. We honor unsubscribe requests promptly. We will continue to send transactional and account-related emails (such as order confirmations, shipping notifications, and wine club updates) as needed to service your account, even if you have unsubscribed from marketing messages.

12. Third-Party Links

Our Site may contain links to third-party websites, such as social media platforms. We are not responsible for the privacy practices of those sites. We encourage you to read the privacy policies of any third-party sites you visit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Effective Date” at the top of this page. If we make material changes, we will provide notice through the Site or by other reasonable means. Your continued use of the Site after the effective date of any updated policy constitutes your acceptance of the updated policy.
