MarAmi Vineyards ("MarAmi," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit maramivineyards.com (the "Site"), purchase wine, join our wine club, or otherwise interact with us (collectively, the "Services"), how we use that information, and the rights and choices you can exercise with respect to it. Our Site and Services are not directed to individuals under the age of 21. If you are not at least 21 years of age, do not continue to use our Site or Services.
Please review this Privacy Policy carefully. If, after reviewing this Privacy Policy, you do not agree with our policies and practices, please discontinue your visit to our Site and do not use our Services. By visiting our Site or using our Services, including by navigating through the Site or providing information through the Services, you acknowledge and agree that MarAmi may process your Personal Data as described in this Privacy Policy.
Different privacy laws around the world describe Personal Data using different terms, including personal data, personal information, and personally identifiable information. In this Privacy Policy, we use the term "Personal Data" to mean the same thing as these other terms. If a specific type of personal data has its own definition, we will provide that definition and use that name specifically.
1. Who We Are
MarAmi Vineyards is a direct-to-consumer winery based in California. We sell wine and offer a wine club to consumers of legal drinking age in jurisdictions where we are permitted to ship.

2. Information We Collect
We collect Personal Data that you provide to us directly or that is collected automatically through standard website analytics tools when you visit the Site and use our Services.
Information You Voluntarily Provide to Us
We collect, and in the past 12 months have collected, the following categories of personal information:
- Identifiers: first and last name, email address, postal address, phone number, and username and password.
- Customer records: information maintained by us that is related to you, including billing and shipping information, order history, wine club membership details, and customer payment tokens.
- Commercial information: information about your transactions with us, including products purchased, considered, or returned, purchase history, and customer payment tokens.
- Internet or other similar network activity: browsing history, search history, and information about your interaction with the Site or our advertisements.
- Geolocation data: information about your physical location or movements.
- Inferences: inferences drawn from the above to create a profile reflecting preferences and characteristics, primarily for product recommendations and marketing.
If you make a purchase from the Site, please note that we do not collect your payment card information directly. Payment is processed by Fullsteam, our payment processor, which provides tokenized payment authentication.
Information Collected Automatically
We may automatically collect certain information through cookies or similar tracking technologies when you access our Site and use our Services. A cookie is a small text file that is stored in your browser or elsewhere on your hard drive. Cookies allow us to identify your device as you navigate our Site or your account. You have the option of using your browser settings to opt out of most categories of cookies other than strictly necessary cookies.
Our e-commerce platform, Commerce7, sets a strictly necessary cookie that stores basic account information such as your name and email address. This cookie is required for core Site functionality; without it, browsing and purchasing will not work correctly. By using our Site, you consent to this strictly necessary cookie being set.
Some internet browsers include the ability to transmit "Do Not Track" signals. To learn more, please visit www.allaboutdnt.com. We do not currently respond to "Do Not Track" browser signals, as no consistent industry standard has been established.
We do honor recognized opt-out preference signals (such as the Global Privacy Control, or GPC) from California residents as a request to opt out of the sharing of personal information for cross-context behavioral advertising, as described in Section 7.
Children's Information
We do not knowingly collect personal information from anyone under the age of 18. We do not sell wine to, and do not knowingly collect information from, anyone under the legal drinking age. If you believe we have inadvertently collected information from a minor, please contact us at contact@maramivineyards.com, and we will delete it.
3. How We Use Your Information
We use the information we collect for the following purposes:
- To create, authenticate, manage, and administer user accounts
- To process and fulfill your wine orders, including age verification, shipping, and payment processing
- To administer your wine club membership and process recurring club shipments
- To communicate with you about your orders, account, or inquiries
- To send marketing emails to customers, wine club members, mailing list subscribers, and contact-form opt-ins, in accordance with applicable privacy laws
- To comply with legal obligations, including alcohol shipping laws, tax laws, and recordkeeping requirements
- To respond to legal process and judicial or regulatory orders
- To administer our Site, improve our Services and internal operations, prevent fraud, and protect the security of our Site and customers
- To enforce and defend our legal rights
Limitation or Change of Purpose
We will use your Personal Data for the purposes for which we collected it. If we need to use it for a different but compatible purpose, we may do so after disclosing the compatible purpose to you. A compatible purpose is one that aligns with the context and intent of the original purpose for which the Personal Data was collected. In contrast, an incompatible purpose is one that is very different from the original purpose, would be unexpected by you, or would have an unjust impact on you. If you would like an explanation of the compatibility of the processing for the new purpose with the original purpose, please contact us.
If we need to use your Personal Data for incompatible purposes, we will notify you either to obtain your consent or to explain the legal basis that allows us to do so without your agreement. Please note that, if required or permitted by law, we may process your Personal Data without your knowledge or consent in accordance with the above rules.
4. How We Share Your Information
We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.
We share information only with service providers that help us operate our business, and only to the extent necessary for them to perform their services. These service providers are contractually required to protect your information and use it only for the purposes we specify. They include:
- Commerce7: our e-commerce platform, which manages customer accounts, orders, wine club memberships, and currently handles transactional and marketing emails.
- Fullsteam (via Commerce7): our payment processor, which handles tokenized payment authentication and processes credit and debit card transactions.
- Shipping carriers: to deliver wine to you, we provide your name, address, and phone number to licensed common carriers.
We may also disclose your information when required by law, such as in response to a subpoena, court order, or other legal process; to enforce our terms; to protect our rights, property, or safety, or that of our customers or others; or in connection with a business transfer, such as a merger or sale of part or all of our assets, in which case we will notify you and any successor will be required to honor this Privacy Policy.
5. How Long We Keep Your Information
We retain your personal information for as long as your account or wine club membership is active, or as long as needed to provide you with our Services. Order history and customer records are retained indefinitely, unless you request deletion.
We may retain certain information for longer than the original purpose for which it was collected if required by law, such as for tax, accounting, or alcohol-shipping recordkeeping purposes, or as needed to resolve disputes, prevent fraud, or enforce our agreements. When we no longer have a legitimate business or legal reason to retain your information, we will delete or anonymize it.
6. Your Privacy Rights
You can unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any marketing message we send, or by contacting us directly. However, opting out of marketing emails will not stop our communications with you for administrative purposes. We will continue to send transactional messages, such as order confirmations and shipping notifications, as necessary to fulfill your purchases for as long as your account is open.
7. Your California Privacy Rights (CCPA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), gives you certain rights regarding your personal information. This section describes those rights and how to exercise them.
Subject to certain exceptions, California residents have the right to:
- Right to know: you may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we share it.
- Right to delete: you may request that we delete personal information we have collected from you.
- Right to correct: you may request that we correct inaccurate personal information we maintain about you.
- Right to opt out of sale or sharing: not applicable, as described above.
- Right to non-discrimination: we will not discriminate against you for exercising any of these rights.
How to Exercise Your Rights
You may exercise your consumer privacy rights twice in a calendar year free of charge. However, a fee may apply if we believe your request is excessive, repetitive, or manifestly unfounded. To exercise any of the above rights, please either (1) email us at contact@maramivineyards.com and specify the request in the subject line of the email (for example, "CA Consumer Privacy Rights: Right to Know Request") with a description of your request; or (2) call us at (818) 439-6481.
We will need to verify your identity before responding, which typically means matching information you provide in your request with information we already have on file, such as your name, email address, or recent order details. We will generally not ask you for more information than is reasonably necessary to verify your identity.
You may also designate an authorized agent to make a request on your behalf. We will require written proof of the agent's authorization and may require you to verify your own identity directly with us.
We will respond to verifiable requests within 45 days. If we need more time, we will let you know and explain why. Please note that some consumer rights are conditional and not absolute. If we deny your request, we will notify you of the reason of the denial within 45 days, and let you know when and how you may appeal that decision.
Shine the Light
California Civil Code section 1798.83 (the "Shine the Light" law) permits California residents to request information about disclosures of personal information to third parties for those third parties' direct marketing purposes. As stated above, we do not share personal information with third parties for their own direct marketing purposes.
8. Consumer Privacy Rights Under Other U.S. State Laws
Residents of other U.S. states with applicable state privacy laws may have similar rights to access, delete, or correct their personal information. To make a request, please email us at contact@maramivineyards.com and specify your state of residence and request in the subject line of the email. We will respond to your request in accordance with applicable law.
9. How We Protect Your Information
We use commercially reasonable technical, administrative, and physical safeguards to protect your Personal Data. Payment card information is tokenized and processed by our payment processor; we do not store full payment card numbers on our systems. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
10. Email Marketing and the CAN-SPAM Act
We send marketing emails to customers, wine club members, mailing list subscribers, and contact-form opt-ins in compliance with the federal CAN-SPAM Act. Every marketing email we send includes a clear way to unsubscribe. We honor unsubscribe requests promptly. We will continue to send transactional and account-related emails (such as order confirmations, shipping notifications, and wine club updates) as needed to service your account, even if you have unsubscribed from marketing messages.
11. Third-Party Links
Our Site may contain links to third-party websites, such as social media platforms. If we have provided a link to any other website or location, it is for your convenience only and does not mean that we endorse that business, website, or its contents. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site's Terms of Use. We are not responsible for the privacy practices of those sites. We encourage you to read the privacy policies and terms of use of any third-party sites you visit.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Effective Date" at the top of this page. If we make material changes, we will provide notice through the Site or by other reasonable means. Your continued use of the Site after the effective date of any updated policy constitutes your acceptance of the updated policy.
